Kotkhai Case: All 5 accused get bail as CBI fails to file charge-sheet
Ashish Chauhan, the first accused arrested by the HP Police SIT was already given bail on October 14. On October 17, all remaining accused were also granted bail.
Shimla: As a huge embarrassment not only of the Himachal Pradesh Police but also for the Central Bureau of Investigation, all remaining five accused have been granted bail by the District and Sessions Court, Shimla, in the Kotkhai rape and murder case.
The news can fuel the distress in public again as it was one of the most gruesome crimes that had sent a wave of shock across Himachal.
As per the law, the investigating agency is required to submit a charge-sheet against the arrested accused. The CBI has failed to do so. It implies that the premier investigation agency of India could not convince the court as to why the accused should not be given bail.
Ashish Chauhan, the first accused arrested by the HP Police SIT was already given bail on October 14.
One of the six arrested accused was allegedly murdered at the Kotkhai Police Station in police custody.
All remaining four accused namely, Subash Singh Bisht (42)and Deepak aliasDepu (38) of Uttarakhand, Rajinder Singh alias Raju (32) of Halaila, and Lokjan alias Chotu (19) of Nepal, were also granted bail on October 17.
The accused will have to furnish a bail bond of Rs one lakh each within a week.
The CBI had been rebuked by the State High Court several times for its repeated failure to file a detailed status report on the investigation despite its own assurances.
Eight police officials of HP Police including then Inspector General, Zahur H Zaidi, and Deputy Superintendent of Police, Theog, Manoj Joshi, were arrested in August in relation to the killing of the accused Suraj Singh in police custody.
